Underdog Fantasy Agrees to $17.5 Million Settlement with New York State Gaming Commission
Underdog Fantasy, a Daily Fantasy Sports (DFS) operator, has reached a settlement of $17.5 million with the New York State Gaming Commission (NYSGC). The agreement comes after an investigation by NYSGC found that Underdog had been offering DFS contests through its subsidiary, Synkt, that were not permitted under New York law. As a result, Underdog has decided to withdraw its drafts and pick’em games from the state market. Despite this setback, the company is looking to return to New York and has applied for a permanent license.

The settlement was announced on Friday following the NYSGC’s investigation. While Underdog denied any wrongdoing and disagreed with the regulator’s interpretation of the law, it chose to settle and pay the fine to avoid a prolonged legal battle. Brian O’Dwyer, NYSGC Commission chair, emphasized the importance of playing only through permitted and regulated operators to protect New Yorkers.
Underdog’s general counsel, Nicholas Green, defended the company’s position by highlighting the regulatory uncertainties surrounding New York’s DFS industry for nearly a decade. He clarified that the issue was related to licensing rules rather than the specific games offered. Despite the temporary withdrawal, Underdog is eager to resume its contests in New York as soon as possible.
Underdog’s Expansion Policy
While facing challenges in New York, Underdog is focusing on expanding its operations in other states. The company plans to introduce its Pick’em Champions product in New Jersey and Delaware by the end of March. This move aligns with Underdog’s goal of growing its business while adhering to local regulations.
Underdog has also adapted its business model to comply with different state regulations. In 16 states, the company offers a peer-to-peer version of its games under the Champions brand. This approach, while not as lucrative as traditional player-versus-house games, has been instrumental in driving Underdog’s expansion across the United States.
Despite the setback in New York, Underdog remains optimistic about its future prospects. By cooperating with state regulators and demonstrating a commitment to compliance, the company aims to secure a permanent fantasy sports license in New York and resume operations in one of its key markets.
